These Terms of Use & Sale ("Terms") govern access to and use of the BDSG Brands website and ordinary direct-to-consumer purchases made directly from BDSG Brands, LLC ("BDSG," "we," "us," or "our").
By creating an account, placing an order, or affirmatively accepting these Terms at checkout, you agree to these Terms. Where BDSG uses a checkbox or other electronic acceptance mechanism, BDSG may retain evidence of the version accepted, date and time, order or account identifier, acceptance record, and available device, IP, or transaction information.
Merely visiting the website does not by itself constitute acceptance of the Binding Arbitration Agreement where applicable law requires affirmative assent.
You must be at least 18 years old or the age of legal majority in your jurisdiction to create an account or make a purchase independently. Minors may use BDSG products under the supervision and responsibility of a parent or legal guardian where appropriate.
BDSG sells cosmetic and personal care products. We attempt to describe products, ingredients, sizes, packaging, appearance, pricing, and availability accurately. Packaging, ingredients, appearance, or specifications may change, and electronic images may not reproduce colors or textures exactly.
Always review the ingredient list, directions, warnings, lot information, and other labeling on the product actually received, particularly if you have allergies or sensitivities.
BDSG products are cosmetic products unless expressly stated otherwise. They are not intended to diagnose, treat, cure, or prevent disease. Website content, product descriptions, educational materials, social-media content, and customer service information are not medical advice.
Individual experiences may vary. If you have a serious skin condition, known allergy or sensitivity, are receiving medical treatment, or are uncertain whether a product is appropriate for you, consult an appropriate healthcare professional. Discontinue use if significant irritation or an adverse reaction occurs.

If BDSG cancels an accepted order after collecting payment, BDSG will refund the applicable amount.
Prices are displayed in U.S. dollars unless otherwise indicated. Prices, promotions, discounts, bundles, shipping offers, and availability may change prospectively. The price displayed at checkout generally governs the transaction unless there is an obvious pricing or technical error.
Applicable taxes, shipping charges, and other charges will be disclosed during checkout as required. Promotional offers may have separate eligibility, expiration, quantity, channel, or combination restrictions. Unless a different offer is displayed at checkout, standard retail free shipping applies to qualifying direct-to-consumer orders of $70 or more.
By providing a payment method, you represent that you are authorized to use it, the information provided is accurate, and you authorize charges associated with the transaction. Payments may be processed by third-party payment providers.
BDSG may use fraud-prevention, payment-risk, address-verification, identity-verification, and transaction-monitoring tools and may delay, decline, or cancel transactions reasonably identified as suspicious or unauthorized.
Delivery dates are estimates unless BDSG expressly guarantees otherwise. BDSG is not responsible for delays caused by circumstances outside its reasonable control, including carrier delays, weather, governmental actions, customs, transportation interruptions, or inaccurate addresses supplied by the customer.
Customers are responsible for providing complete and accurate shipping information.
Returns and refunds are governed by the BDSG Return & Refund Policy, which is incorporated into these Terms. Ordinary Retail and Greatness Member product returns are generally limited to eligible unopened products requested within 15 calendar days from the purchase date.
Damaged, defective, incorrect, leaking, contaminated, or materially nonconforming products are handled separately and are not denied solely because the product was opened in the ordinary course of discovering the issue.
You are responsible for maintaining accurate account information and protecting account credentials. Notify BDSG promptly if you believe an account has been compromised. BDSG may suspend or terminate accounts reasonably associated with fraud, security threats, deliberate abuse, or repeated violations of these Terms.
You retain ownership of original content you submit. By voluntarily submitting a review, photograph, video, testimonial, comment, or other content for publication or promotional use, you grant BDSG a nonexclusive, worldwide, royalty-free license to use, reproduce, display, distribute, adapt, and promote that content in connection with BDSG business, subject to applicable law and any separate written agreement.
BDSG trademarks, logos, product names, packaging, designs, graphics, photographs, video, copy, website content, and other brand materials are owned by or licensed to BDSG. Purchasing a product does not grant a right to reproduce, alter, or commercially exploit BDSG intellectual property.
BDSG encourages customers to contact BDSG promptly regarding billing, delivery, refund, or transaction concerns so that BDSG has an opportunity to investigate and resolve the issue. Nothing in these Terms eliminates a chargeback, billing-error, or payment-dispute right that applicable law or payment-network rules do not permit the parties to waive.
The website may use or link to services operated by payment processors, shipping carriers, analytics providers, advertising providers, social platforms, or other third parties. Their services may be governed by separate terms and privacy practices. BDSG is not responsible for third-party services outside its control.
To the maximum extent permitted by law, the BDSG website and online services are provided "as is" and "as available." BDSG does not warrant that online services will always be uninterrupted, error-free, or completely secure. This section does not DISCLAIM an express product warranty or non-waivable consumer right.
To the maximum extent permitted by law, BDSG will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from website use or ordinary contractual services. For claims that may lawfully be subject to a contractual cap, BDSG's aggregate contractual liability will not exceed the amount paid to BDSG for the product or service giving rise to the claim.
To the maximum extent permitted by law, you agree to indemnify and hold harmless BDSG Brands, LLC and its affiliates, owners, members, managers, officers, employees, and agents from third-party claims, losses, liabilities, reasonable attorneys' fees, penalties, damages, and costs to the extent caused by or arising from your use of the website, purchase of products, violation of these Terms, or violation of applicable law.
Except for the exceptions below, you and BDSG agree that disputes arising out of or relating to these Terms, website use, or product purchases will be resolved through binding individual arbitration rather than a lawsuit in court.
The Federal Arbitration Act governs interpretation and enforcement of this Arbitration Agreement to the extent applicable.
To the maximum extent permitted by law, you and BDSG waive the right to have an arbitrable dispute decided by a judge or jury and agree that arbitrable claims may be brought only on an individual basis, not as a class, collective, representative, or consolidated action.
You may opt out of this Arbitration Agreement within 30 days after first affirmatively accepting it using the opt-out method provided by BDSG. Opting out does not cancel your account or any substantive provision other than the Arbitration Agreement.
This Agreement is governed by Utah law and applicable federal law, without regard to conflict-of-law principles. For disputes not subject to arbitration and not properly brought in small claims court, the parties consent to an appropriate state or federal court located in Utah.
BDSG may revise these Terms prospectively. Material changes may require renewed affirmative acceptance before you continue to use affected services. BDSG may preserve prior versions to establish which version governed a particular transaction.
If a provision is invalid or unenforceable, it will be limited or severed to the minimum extent necessary and the remainder will remain effective where legally permitted.
